It counts if both are under. Statitory basicly just means that at least one is underage and took advantage of the other. At least in one set of parents eyes.

over 18 it's just plain sex...
rape is rape no matter what age, but statutory rape means that there was no means of giving consent because the law says that anyone under the "magical arbitrary age" is incapable of giving consent. So Jack gets busted even if Jill says "yes", signs a paper, and initiates the sexual contact herself, because legally she doesn't have the ability to give her own consent.
So, to review:
Jack has sex with Jill, Jill says "yes", but Jill is underage = BUSTED
Jack has sex with Jill, Jill says "yes", Jill is of or over the age of consent = OK

unless she's smart and says that she was the one who was raped, in which case a routine pelvic "rape kit" exam would show evidence of sexual activity, and it's basically her word and the physical evidence against his word...
unless, of course, he can prove that he was really unconscious (ie: blood test proving trace amounts of drugs used to knock him out, or a big fucking bruise on his head), in which case he would also have physical evidence and his own word against hers...
but most really evil an manipulative girls like that can be careful enough to not leave any clues of that sort of thing

it barely works both ways, people are 95% always goign to find (courtwise) on the side of women, even if they were the ones who did wrong. My car was hit by this one girl, it caused over 2000 dollars worth of damage, I had a buddy with me and she was alone.
I was found at fault for the accident. Why? Because she lied and said I hit her. I had a witness, she didn't. It was becuase (and my insurance agent told me this) because she was a girl and unless there is a 10 mile high mountain of evidence proving otherwise them folks who make the decisions go with the girls testimony as the truth.
